Rental Application Criteria and Guidelines

Before you apply

ALL applications are subject to the below terms and conditions, please read them carefully.


Portable Tenant Screening


Portable Tenant Screening Reports (PTSR): 1) Applicant has the right to provide Aspen Management with a PTSR that is not more than 30 days old, as defined in § 38-12-902(2.5), Colorado Revised Statutes; and 2) ifApplicant provides Aspen Management with a PTSR, Aspen Management is prohibited from: a) charging Applicant a rental application fee; or b) charging Applicant a fee for Aspen Management to access or use the PTSR.


Pursuant to Landlord's rights, if Applicant provides Aspen Management with a PTSR: a) the PTSR must be available to Aspen Management by a consumer reporting agency/third-party website that regularly engages in the business of providing consumer reports; 2) the PTSR must comply with all state and federal laws pertaining to use and disclosure of information contained in a consumer report by a consumer reporting agency; and c) Applicant certifies that there has not been a material change in the information in the PTSR, including the Applicant’s name, address, bankruptcy status, criminal history, or eviction history, since the PTSR was generated.


Colorado Revised Statute, C.R.S. § 38-12-902(2.5) defines a Portable Screening Report (PTSR), and any PTSR submitted by you, must meet the following definition.

(2.5) “Portable tenant screening report” or “screening report” means a consumer report prepared at the request of a prospective tenant that includes information provided by a consumer reporting agency, which report includes the following information about a prospective tenant and the date through which the information contained in the report is current:


(a)        Name;

(b)       Contact information;

(c)        Verification of employment and income;

(d)       Last-known address;

(e)        For each jurisdiction indicated in the consumer report as a prior residence of the prospective tenant, regardless of whether the residence is reported by the prospective tenant or by the consumer reporting agency preparing the consumer report.


(I) A rental and credit history report for the prospective tenant that complies with section 38-12-904(1)(a) concerning a landlord's consideration of a prospective tenant's rental history; and


(II) A criminal history record check for all federal, state, and local convictions of the prospective tenant that complies with section 38-12-904(1)(b) concerning a landlord's consideration of a prospective tenant's arrest records.

Further, pursuant to C.R.S. § 38-12-904(1.5)(b), landlords may require:

(I)         That the screening report was completed within the previous thirty days;


(II)        That the screening report is made directly available to the landlord by the consumer reporting agency for use in the rental application process or provided through a third-party website that regularly engages in the business of providing consumer reports and complies with all state and federal laws pertaining to use and disclosure of information contained in a consumer report by a consumer reporting agency;


(III)       That the screening report is made available to the landlord at no cost to access or use in the rental application process; and

(IV)      A statement from the prospective tenant that there has not been a material

 

change in the information in the screening report, including the prospective tenant's name, address, bankruptcy status, criminal history, or eviction history, since the report was generated.


Pursuant to Landlord’s Rights, except for applicant’s credit history, Landlord insists that any PTSR provided by you meets these additional requirements


Application Terms


Please be prepared to pay the application fee for each person applying as outlined in the property listing. In addition to this rental application, you will also be required to provide a copy of a valid form of identification and proof of income.

To complete a rental application, you must be prepared to provide 3 years of residential history as well as contact information for your rental references. You will also be asked to provide information on your monthly income. Please note that most properties require that applicant combined gross income is at least three (3) times the monthly rent amount.


Each resident over the age of 18 must submit a separate rental application.


Application fees consist of the following actual expenses:

$39.45 - Credit criminal screening

$23.00 - Staff time (1/2 hour)

$3.00    - AppFolio software cost (1/2 hour)

$15.07 - Office cost (1/2 hour)

Total cost of running an application $80.52


For application approval applications need to meet ALL FOUR of the following minimum approval requirements:

1.  The combined monthly income of all applicants must be no less than two hundred percent (200%) of the annual rental rate

2.  Applicant(s) must not have a criminal record

3.  Credit score, > 750 = automatic conditional approval, 700 - 749 = manager review conditional approval, 650 - 699 = manager review, security deposit of 1.5 times advertised rental rate required, 600 - 649 = manager review, security deposit of 2 times advertised rental rate required, < 600 = automatic denial

4.  Positive reference from prior landlord


The following Application Agreement will be signed by all applicants prior to signing a lease contract. While some of the information below may not yet be applicable to your situation, there are some provisions that may become applicable prior to signing a lease contract. In order to continue with this online application, you will need to review the Application Agreement carefully and acknowledge that you accept its terms.


1.         Applicant acknowledges receipt of Brokerage Disclosure to Tenant.


2.     Lease Contract Information. The Lease Contract form contemplated by the parties is available for review at aspen-mgmt.com and can be provided upon request. Applicant acknowledges the availability of the Lease Contract form and BY APPLYING ACCEPTS THE BASE TERMS AND CONDITIONS OF THE LEASE CONTRACT.


3.         Application Fee (nonrefundable). You have delivered an application fee and this payment partially defrays the cost of administrative paperwork. It is nonrefundable.


4.         Holding Deposit (MAY NOT BE REFUNDABLE). In addition to any application fee, applicant will be required to  deliver a Holding Deposit. The Holding Deposit is not a security deposit. However, it will be credited toward the required security deposit when the Lease Contract has been signed by all parties; OR it will be refunded under paragraph 9 if you are not approved; OR it will be retained by us, as liquidated damages, if you fail to execute a Lease Contract per sections 5 and 6 of this Application Agreement.


5.         Approval When Lease Contract Isn't Yet Signed. If you and all co-applicants have not signed the Lease Contract when we approve the Application, our representative will notify you (or one of you if there are co-applicants) of the approval. Upon execution of the Lease Contract the Holding Deposit of all applicants will be credited toward the required security deposit.


6.         IF YOU FAIL TO SIGN A LEASE CONTRACT AFTER APPROVAL OF APPLICATION. UNLESS WE AUTHORIZE OTHERWISE IN WRITING, YOU AND ALL CO-APPLICANTS MUST SIGN THE LEASE CONTRACT WITHIN 3 DAYS AFTER WE GIVE YOU OUR APPROVAL IN PERSON, BY TELEPHONE, BY EMAIL, BY MAIL OR BY ANY OTHER FORM OF NOTICE. IF YOU OR ANY CO-APPLICANT FAILS TO SIGN AS REQUIRED, WE WILL KEEP THE HOLDING DEPOSIT, IN ITS ENTIRETY, AS LIQUIDATED DAMAGES AND ALL FURTHER OBLIGATIONS UNDER THIS APPLICATION WILL BE TERMINATED


7.         If You Withdraw Before Approval. You and any co-applicant may withdraw your application or the holding deposit, if and only if you have not yet been approved. If you or any co-applicant withdraws an Application or notifies us that you have changed your mind about renting the dwelling unit PRIOR TO APPROVAL the parties will then have no further obligation to each other. Under no circumstance will the application fee be refunded provided a background investigation has commenced.


8.         Completed Application. An Application will not be considered "completed" and will not be processed until all of the following have been provided to us: a separate Application has been fully filled out and signed by you and each co-applicant; an application fee has been paid to us by each applicant; a Holding Deposit has been paid to us.


9.         Non-Approval. We will notify you whether you've been approved within 10 days after the date we receive a completed Application. Your Application will be considered "disapproved" if we fail to notify you of your approval within 10 days after we have received a completed Application. Notification may be in person or by email or by mail or telephone unless you have requested that notification be by mail. You must not assume approval until you receive actual notice of approval. The 10-day time period may be changed only by separate written agreement.


10.       Refund After Non-Approval. If you or any co-applicant is disapproved or deemed disapproved under paragraph 8, we will refund all Holding Deposits within 30 days of such disapproval less any transaction costs incurred by you in the transmission of funds. NOTE - IF YOU ELECT TO PAY ANY PORTION OF FUNDS WITH A CREDIT CARD THEY WILL BE PROCESSED BY APPFOLIO, APPFOLIO CHARGES PROCESSING FEES WHICH DO NOT BENEFIT ASPEN MANAGEMENT AND ASPEN MANAGEMENT IS NOT RESPONSIBLE FOR REFUNDING PROCESSING FEES IN WHOLE OR IN PART. FUNDS PAID BY CREDIT CARD CANNOT BE REFUNDED TO THE ORIGINAL FORM OF PAYMENT, REGARDLESS OF ORIGINAL PAYMENT METHOD, ANY REFUND ISSUED WILL BE IN THE FORM OF A PAPER CHECK MAILED TO THE CURRENT OR LAST KNOWN ADDRESS DISCLOSED BY YOU ON YOUR APPLICATION. Refund checks may be made payable to all co-applicants and mailed to one applicant.


11.       Extension of Deadlines. If the deadline for signing, approving, or re-funding under paragraphs 5, 8, or 9 falls on a Saturday, Sunday, or a state or federal holiday, the deadline will be extended to the end of the next business day.


12.       Notice to or from Co-applicants. Any notice we give you or your co-applicant is considered notice to all co-applicants; and any notice from you or your co-applicant is considered notice from all co-applicants.


13. Admin Fee. All executed Lease Contracts are subject to a $300.00 admin fee. 


14.       Keys or Access Devices. We will furnish keys and/or access devices only after: (1) all parties have signed the contemplated Lease Contract and other rental documents referred to in the Lease Contract; and (2) all applicable rents, fees and security deposits have been paid in full.


15.       Communication. Applicant(s) agree to receive any and all communications with regards to this application via electronic mail or electronic communication.


16.       Signature. Our reception of this application is consent only to this Application Agreement. It does not bind us to accept applicant or to sign the proposed Lease Contract.
